Interim Measures for the Supervision and Administration of the Quality and Safety of Food-related Products (State Administration of Market Regulation (SAMR) Order [2022] No. 60).
Article 1 In order to urge enterprises to implement the primary responsibility of food safety, strengthen the food safety responsibility of the key persons in charge of enterprises, and standardize the behavior of food safety management personnel, the Regulations are formulated in accordance with the Food Safety Law of the People's Republic of China and its implementation regulations and other laws and regulations.
Article 2 Within the territory of the People's Republic of China, the key persons in charge of food production and operation enterprises, food safety directors, food safety officers and other food safety management personnel, and their supervision and management shall be governed by the Regulations.
Article 3 Food production and operation enterprises shall establish and improve the food safety management system, implement the food safety responsibility system, employ food safety management personnel such as food safety director and food safety officer who are suitable for the enterprise scale, food category, risk level, management level and safety status according to law, and clarify the post responsibilities of the key person in charge, food safety director and food safety officer of the enterprise.
The key person in charge of the enterprise is fully responsible for the enterprise's food safety service, and the establishment and implementation of the long-term mechanism of the primary responsibility for food safety. The food safety director and officer shall assist the key person in charge of the enterprise in food safety management according to their job duties.
Article 4 The key person in charge of food production and operation enterprises shall support and safeguard the food safety director and officer in accordance with the law to carry out food safety management work, and shall listen to their opinions and suggestions before making major decisions concerning food safety.
If the food safety director and/or food safety officer find that there are potential risks of food safety accidents, they shall put forward veto suggestions such as stopping relevant food production and business activities, and enterprises shall immediately analyze and judge, and take disposal measures to eliminate potential risks.
